This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products (Products) listed on our website (located at www.stitchdesignworks.com as well as with the extensions .co.uk and .eu) (Website) to you. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.

You should print a copy of these terms and conditions for future reference.

You will be asked to click on the button marked "I Accept" at the end of these terms and conditions as part of the ordering process if you accept them. Please understand that if you refuse to accept these terms and conditions, you will not be able to order any Products from our site.

We are registered in England and Wales under company number 4186140 and with our registered office at Senate Court, Southernhay Gardens, Exeter EX1 1NT and trading address at Cranston House, 5 Wain-a-Long Road, Salisbury, Wiltshire, SP1 1LJ. Our VAT number is GB 887559547.

Your status

By registering as a customer and submitting an order to us through our website, you guarantee that:

  • the personal information and payment details you provide are true, accurate, current and complete in all respects
  • you will notify us immediately of any changes to your Personal Information by e-mail, or calling us on +44 (0) 1722 325304 between 9am-5.00pm Mon - Fri
  • you agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use
  • if the billing details for your order are the same as your delivery address details, by placing an order on the website you confirm that you are the person referred to in the delivery address details. Otherwise, by placing an order, you confirm that you are the person referred to in the billing details

Product description

We take great care in portraying the products on our Website as accurately as possible, ensuring that product descriptions and specifications are correct at time of publication. However, colour reproduction and image representation are dependent on your monitor's display and colour capability so we cannot accept responsibility for any colour misrepresentation or variation.

At times it may be necessary to make changes to the specifications of our products and we reserve the right to make such changes without notice.

Product availability/Pricing policy

Once an item is sold out it will be taken off the website at the earliest opportunity and may not be available again.

All prices shown on the web-site are in £ sterling and are inclusive of VAT. There is an additional charge for Delivery.

Please note offers may be withdrawn at any time.

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

Our site contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, we will charge the lower amount when dispatching the

Product to you. If a Product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection.

We are under no obligation to provide the Product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

VAT is deducted from all export orders but any customs or import duties will be your responsibility.

How the contract is formed between you and us

After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted.

Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the Dispatch Confirmation). The contract between us (Contract) will only be formed when we send you the Dispatch Confirmation.

The Contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.

Orders

All orders are subject to availability.

We will send to you an order acknowledgement e-mail detailing the products you have ordered. This e-mail is not an order confirmation or order acceptance from Stitch Designworks. Please contact us on +44 (0) 1722 325304 should you not receive an acknowledgement e-mail within 5 business working days.

Non-acceptance of an order may be a result of one of the following:

  • The product you ordered being out of stock
  • Our inability to obtain authorisation for your payment
  • The identification of a pricing or product description error
  • Our inability to arrange delivery to your address

Failure to meet the eligibility to order criteria set out in these Trading Terms

We will take all reasonable care, in so far as it is our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Delivery Information

UK home delivery service

Providing we have your item(s) in stock, we usually dispatch orders within 2 business working days to arrive with UK customers within the following 2-5 days depending on the service used and delivery address. Please note that we are unable to guarantee these estimated delivery dates. Please be aware that your order will take a little longer to process if you place it on a Friday or a Saturday.

On request, we may be able to expedite delivery for customers, please call for availability and pricing.

We will notify you if there will be a delay, offering you the option of keeping the goods on backorder or receiving a refund.

We use Royal Mail First Class, Parcel Post or a courier service to deliver your order.

Please note that our courier service requires a signature on receipt. If the courier is unable to deliver, a card will be left with a contact number to arrange re-delivery or collection from the nearest depot. Please note, if no contact is made with the couriers within 7 days of attempted delivery, the goods will automatically be returned to us.

Our delivery charge for re-despatch of returned goods will include the courier's 2-way charge for returning the original package to us.

UK mainland delivery charge: £3.95 - subject to change.

Home delivery service outside mainland UK

Please contact us for prices and delivery to other destinations: we welcome international and BFPO orders.

VAT is deducted from all export orders but any customs or import duties will be your responsibility.

Payment methods

We accept on-line payment by credit card using (PayPal) who will verify and authorise your card payment.

Please note that Stitch Designworks does not accept cash or cheques as payment for on-line orders.

Order cancellation

You may cancel your order (once accepted by us) for any reason up to the point of dispatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days.

If you wish to cancel your order please contact Stitch Designworks customer services by calling +44 (0) 1722 325304 between 9am and 5pm Monday to Friday or returning your order acknowledgement e-mail to us stating your intention to cancel the order.

Consumer rights

If you are contracting as a consumer, you may cancel a Contract at any time within seven working days, beginning on the day after you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our refunds policy (set out below).

To cancel a Contract, you must inform us in writing and return the Product(s) to us immediately, in the same condition in which you received them, and at your own cost and risk.

Details of this statutory right, and an explanation of how to exercise it, are provided in the Dispatch Confirmation. This provision does not affect your statutory rights.

Our returns policy

When you return a Product to us (for instance, because you have cancelled the Contract between us, or because you claim that the Product is defective), we will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will usually process the refund due to you as soon as possible and, in any case, within 30 days of the day we received your cancellation or the day we confirmed to you via e-mail that you were entitled to a refund for delivery of the defective Product.

Products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us.

Products returned by you within the seven-day cooling-off period (see paragraph above) will be refunded in full, including the cost of sending the item to you. However, you will be responsible for the cost of returning the item to us.

Please take extra care to read our product care labels as we cannot accept items for refund or exchange if the damage has been caused by incorrect washing.

To return an item to us, complete the returns section on the invoice dispatched with your order. Re-use parcel packaging, remembering to enclose the completed invoice and to affix correct postage and send to:

When returning any items you are strongly recommended to obtain proof of posting. We cannot accept responsibility for parcels lost in transit.

Risk and title

The Products will be at your risk from the time of delivery.

Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

Our rights

We reserve the right to modify or withdraw this Website at any time without notice to you and you confirm that we shall not be liable to you for any such modification and/or withdrawal.

We reserve the right to change these Conditions from time to time and also to terminate your use of the Website. It is your responsibility to check regularly to establish whether the Conditions have been changed and if you do not agree to any changes in the Conditions you must stop using our Website immediately.

Liability and indemnity

We warrant to you that any Product purchased from us through our site is of satisfactory quality.

Our liability in connection with any Product purchased through our site is strictly limited to the purchase price of that Product.

This does not include or limit in any way our liability:

For death or personal injury caused by our negligence;

Under section 2(3) of the Consumer Protection Act 1987;

For fraud or fraudulent misrepresentation; or

For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

We accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

Import duty

If you order Products from our site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination.

You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Law

Our Website and our Terms and Conditions have been designed for use within the United Kingdom. These Terms and Conditions and all matters connected with any order you place are governed by the laws of England and you agree irrevocably to submit to the exclusive jurisdiction of the courts of England.
